Agency Guarantee

The following is our Agency Guarantee at Little Sunshines Agency.

1. 1. The Agency Guarantee is applicable for permanent placements and for short term contracts of 6 months or more
   2. Provided that the Agency Fee was settled in full, i.e. within 3 days from date of invoice, the Client is entitled to the Agency Guarantee.
   3. The Client is entitled to a single replacement agency guarantee per placement fee paid.
   4. In the event that the Candidate reneges on employment the Agency will use its skills and knowledge to find a suitable Candidate to replace the Candidate at no extra charge to the Client, provided that:
      1. the Client did not make changes to the following AFTER the Letter of Appointment & Acceptance was sent and prior to the Candidate commencing employment:
         1. Salary
         2. Petrol reimbursement
         3. Days that the candidate needs to work
         4. Times that the candidate needs to work
         5. Start date
   5. In the event that the candidate resigns within 4 months from date of commencement of employment the Agency will use its skills and knowledge to find a suitable Candidate to replace the Candidate at no extra charge to the Client.
   6. In the event that the family dismisses within 4 months from date of commencement of employment the Agency will use its skills and knowledge to find a suitable Candidate to replace the Candidate at no extra charge to the Client.
   7. For positions where the placement fee exceeds R15 000 the above guarantee mentioned in point 1 to 6 above is a 6 month guarantee from date of commencement of employment, not a 4 month guarantee.
   8. No agency fees will be refunded even in the unlikely event of a replacement candidate not being found through the agency.
      1. though a “banked replacement” will be noted on the system for a once-off single future use.
   9. No agency fees will be refunded even if the Client no longer wishes to hire a candidate, regardless of the reason.

   10. No agency fees will be refunded even if the Client finds another candidate privately or through another agency.

   12. Any refunds due are at the sole discretion of the Agency.
   13. In the highly unlikely event that a refund is granted by the Agency, it will be limited to an amount of 25% of the amount paid by the Client.
       1. In the event of a refund being granted the amount in question will be paid over to the Client within 21 days from the day the refund was granted by the Agency (as per the Consumer Protection Act).
       2. In the event that the 25% refund is granted by the Agency, the Client forfeits the “banked replacement”.

General

• Once the Client engages in utilizing the services of the Agency, and commences interviewing Candidates of the Agency, both the Client and the Agency will automatically be bound by the Agency Terms, regardless of whether actual signature of the Agency Terms has occurred.
